Our business terms are as follows:

TERMS OF USE OF 5LETTERBRANDS SERVICES

The services that 5LetterBrands, Inc. (“5LetterBrands”) makes available to you (“You”) are subject to the following terms and conditions of use (“Terms”). 5LetterBrands reserves the right to update its Terms at any time without providing any notice to You. The most current version of the Terms can be found by clicking on the ‘Terms’ link in the footer of 5LetterBrands’ web pages.

ACCEPTANCE OF TERMS

The services provided by 5LetterBrands (“Services”) includes all facilities and services offered with or without charge by 5LetterBrands, either through its website (hosted at internet domain 5letterbrands.com and its sub-domains and affiliated domains), or directly from 5LetterBrands. By using 5LetterBrands Services, You agree to accept and be bound by these Terms. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, DO NOT USE ANY OF THE SERVICES.

DESCRIPTION OF SERVICES

5LetterBrands owns and/or operates one or more websites (hosted at internet domain 5letterbrands.com and its sub-domains and affiliated domains, which may include shortnamebrands.com, 3letterbrands.com, 4letterbrands.com, 6letterbrands.com, 7letterbrands.com and others), collectively known as the “Site”. 5LetterBrands offers for sale and sells brand packages. A “Brand Package” includes at least rights to an internet dot-com domain and one or more logo designs, in digital format, designed by a professional designer and associated with the dot-com domain. The Services made available by 5LetterBrands include all forms of information, images, facilities, tools and other capabilities that allow You to search, browse or otherwise find and view information about one or more Brand Packages, as well as all and any other services made available from time to time via the Site or directly by 5LetterBrands. Brand Packages are made available for sale either via the Site, directly by 5LetterBrands or indirectly via authorized representatives of 5LetterBrands.

FURTHER AGREEMENTS

In the event that You commence the process of purchasing a Brand Package from 5LetterBrands, You agree to be bound by the terms and conditions of the Brand Purchase Agreement available to view here. In the event that You agree to become a Logo Designer affiliated with 5LetterBrands, either by sign up on the Site or otherwise, You agree to be bound by the terms and conditions of the Logo Designer Agreement. In the event that You agree to become a Brand Partner affiliated with 5LetterBrands, either by sign up on the Site or otherwise, You agree to be bound by the terms and conditions of the Brand Reseller Agreement. In the event that You agree to become a Domain Owner affiliated with 5LetterBrands, either by sign up on the Site or otherwise, You agree to be bound by the terms and conditions of the Domain Owner Agreement. Any other agreements that might apply in connection with the use of the Site and Services will only be those explicitly agreed between 5LetterBrands and You in writing.

NOTICE REGARDING CONTENT AND SERVICES AVAILABLE ON THE SITE

“Content” includes all documents, text, images, logos, descriptions, blog entries, press releases, FAQs and other information intended by 5LetterBrands for legal and authorized viewing or download from the Site. Except as may be specifically set forth herein and in any other agreements with You, 5LetterBrands grants permission to use all Content from the Site, provided that: (1) the copyright notice below appears in all copies, (2) use of such Content from the Site is for informational, internal and non-commercial or personal use only and will not be copied, posted, published or broadcast in any media, and (3) no modifications to any content are made. Use for any other purpose is expressly prohibited, and may result in severe penalties. Violators will be prosecuted to the maximum extent possible.

5LETTERBRANDS AND/OR ITS RESPECTIVE SUPPLIERS AND/OR AFFILIATES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE SERVICES OR CONTENT PUBLISHED AS PART OF THE SITE FOR ANY PURPOSE. ALL SUCH SERVICES AND CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. 5LETTERBRANDS AND/OR ITS RESPECTIVE SUPPLIERS AND/OR AFFILIATES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SERVICES AND CONTENT, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, EXPRESS, IMPLIED OR STATUTORY AND, WITHOUT LIMITATION, ANY IMPLIED FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL 5LETTERBRANDS, ITS SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND/OR SUPPLIERS BE LIABLE FOR LOSS OF PROFITS OR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE CONTENT, SERVICES, SITE OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). CONTENT PUBLISHED ON THE SITE OR IN OTHER FORMS BY 5LETTERBRANDS MIGHT INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. 5LETTERBRANDS AND/OR ITS RESPECTIVE SUPPLIERS AND AFFILIATES MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE CONTENT DESCRIBED HEREIN AT ANY TIME.

USE OF SERVICES

The Services may include brand albums, domain lists, comment areas, forums, messaging services, communities and/or other communication facilities designed to enable you to communicate with 5LetterBrands and/or others. You agree to use the Services only to post, send and receive material and messages that are proper and appropriate. You agree that when using the Services, You will not, without limitation: (1) use any images, information or other material in any way that infringes the intellectual property rights of 5LetterBrands and/or its suppliers and/or any third-parties; (2) upload, distribute or otherwise make available any images, information or other material that in any way infringes the intellectual property rights of any third-parties (3) use the Services to send or receive junk email, spam or any other form of unsolicited messages; (4) abuse, defame, harass, threaten or otherwise violate the legal rights of others; (5) post, upload, distribute or disseminate any defamatory, inappropriate, indecent, obscene, profane or unlawful images, information, name or topic; (6) post, upload, distribute or disseminate any files that contain time bombs, Trojan horses, viruses, worms or any other similar software or programs that may damage the operation and/or property of 5LetterBrands or any third-party; (7) copy or download any file that you know, or reasonably should know, cannot be legally copied, downloaded and/or distributed in such manner; (8) delete or modify any Content except for that which You uploaded yourself and are authorized to delete or modify; (9) in any way deliberately limit or restrict any other user from using and enjoying the Services; (10) gather personal information about other users, including any contact information; and (11) infringe or violate any applicable laws or regulations.

MEMBER ACCOUNT, PASSWORD, AND SECURITY

For Services that require You to sign up with an account, you must complete the registration process by providing 5LetterBrands with current, complete and accurate information, as requested by the applicable registration form. You will also choose a password. You are entirely responsible for maintaining the confidentiality of your account details and password. Furthermore, You are fully responsible for any and all activities that occur under your account. You agree to notify 5LetterBrands immediately of any unauthorized use of your account or other security breach that You become aware of. 5LetterBrands is not liable for any loss that You may incur as a result of someone else using your account or password, either with or without your knowledge. However, You could be held liable for losses incurred by 5LetterBrands or another party due to someone else using your account or password. You may not use anyone else's account at any time, unless you have proof of permission from the account holder.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Services, You will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the Services in any manner that could damage, disable, overload, or impair any of 5LetterBrands’ or its affiliates’ server(s), or network(s) connected to those server(s), or interfere with any other party's use of any Services. You may not attempt to gain unauthorized access to any Services, accounts, computer systems or networks connected to any of 5LetterBrands’ or its affiliates’ server(s) or to any of the Services, through hacking, password mining or other means. You may not obtain or attempt to obtain any materials or information through any means not authorized by 5LetterBrands. 5LetterBrands reserves the right to review any and all materials posted to the Site and to modify, refuse to upload or remove any materials at its sole discretion. 5LetterBrands reserves the right to terminate some or all of your access to the Site and Services at any time, without notice, for any reason whatsoever. 5LetterBrands reserves the right at all times to disclose any Content or information to satisfy any applicable law, regulation, legal process or governmental request, at its sole discretion.
